At DeMark Home Ontario we understand the importance of privacy and the protection of personal information. Working with financial institutions involves sharing your personal information and we are committed to maintaining the confidentiality, security and accuracy of your personal information. We have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information.

DeMark Home Ontario’s Privacy Policy defines our commitments to our business partners, customers and employees and describes our corporate culture.

What is personal information?

We consider “personal information” to mean any information, recorded in any form, about an identified individual, other than business contact information (e.g. name, title, business address). DeMark Home Ontario, in the course of its activities, will collect personal information, which may include: Identification information such as name, home address, telephone, personal email address, date of birth, social insurance number (SIN) and marital status;
Employment information such as salary, job title, references; Other information necessary to DeMark Home Ontario`s purposes, which may be voluntarily disclosed in the course of our relationship.

Why DeMark Home Ontario Collects Personal Information

We collect, maintain, use and disclose different types of personal information about individuals with whom we interact. This includes: Contact and identification information, such as name, address, telephone number and e-mail address; Determining customer eligibility for financial products, including identifying customers or guarantors; assessing credit applications and conducting initial and periodic credit checks; Customer relationship information, such as customer service requests; and Business relationship information; Meeting legal and regulatory requirements, including tax or other reporting requirements.

Where permitted or required by applicable law or regulatory requirements, we may collect information about you without your knowledge or consent.

How DeMark Home Ontario Collects and Uses Personal Information

DeMark Home Ontario will only collect, use and disclose personal information for purposes that would be considered reasonable under most circumstances. We use only fair and lawful methods to collect personal information. Unless permitted by law, no personal information is collected without first obtaining the consent of the individual to the collection, use and dissemination of that information.

Our use of Personal Information is limited to the purposes described in this Policy. DeMark Home Ontario does not otherwise sell, trade, barter, exchange or disclose for consideration any Personal Information it has obtained.

When DeMark Home Ontario May Disclose Your Personal Information

Your personal information may be disclosed when required by law or by order or requirement of a court, administrative agency or governmental tribunal; where DeMark Home Ontario believes, upon reasonable grounds, that it is necessary to protect the rights, privacy, safety or property of an identifiable person or group; where the information is public; to employees, contractors, consultants and other parties (including other members of DeMark Home Ontario) who require the information to assist us to establish, maintain and manage our business relationship with you, including, for example, third parties that provide services to us or on our behalf or third parties that collaborate with DeMark Home Ontario in the provision of services to you.

DeMark Home Ontario may disclose your personal information to credit bureaus or financial institutions involved in determining initial and ongoing customer eligibility for products and services; who are involved in the transfer of all or part of the assets or business of DeMark Home Ontario in connection with the securitization, sale, assignment and/or financing or our financial transactions; who are in the payment system including financial institutions or payment organizations.

We may use or disclose your personal information without your knowledge or consent where we are permitted or required by applicable law or regulatory requirements to do so.

Consent

Your provision of personal information to DeMark Home Ontario means that you agree and consent that we may collect, use and disclose your personal information in accordance with this Privacy Policy. Consent may be withdrawn or changed, subject to legal or regulatory requirements. If you have a credit product or have provided a guarantee, you may not withdraw your consent to share your personal information with other lenders and credit bureaus, as it is necessary to support the credit approval process.

We may collect, use or disclose your personal information without your knowledge or consent where we are permitted or required to do so by applicable law or regulatory requirements.

The Accuracy and Retention of Personal Information

DeMark Home Ontario endeavours to ensure that any Personal Information provided and in its possession is as accurate, current and complete as necessary for the purposes for which we use that information. If we become aware that Personal Information is inaccurate, incomplete or out of date, DeMark Home Ontario will revise the Personal Information and, if necessary, use its best efforts to inform third parties which were provided with inaccurate information so that those third parties may also correct their records.

We keep your Personal Information only as long as it is required for the reasons it was collected. The length of time we retain information varies, depending on the purpose for which it was collected and the nature of the information. This period may extend beyond the end of your relationship with us but it will be only for so long as it is necessary for us to have sufficient information to respond to any issues that may arise at a later date. When your Personal Information is no longer required for DeMark Home Ontario’s purposes, we have procedures to destroy, delete, erase or convert it into an anonymous form.

Protection of Personal Information

DeMark Home Ontario endeavours to maintain appropriate physical, procedural and technical security with respect to its offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of Personal Information. This also applies to our disposal or destruction of Personal Information.

We audit our procedures and security measures from time to time to ensure that they remain effective and appropriate.

Access to Your Personal Information

DeMark Home Ontario permits the reasonable right of access and review of Personal Information held by us about a Member and will endeavor to provide the information in question within a reasonable time and no later than 30 days following the request. Where information will not or cannot be disclosed, the individual making the request will be provided with the reasons for non-disclosure.

DeMark Home Ontario will not charge a Member for verifying or correcting his/her Personal Information.

Evolving practices

This statement is in effect as of July 23, 2012.  DeMark Home Ontario will from time to time review and revise its privacy practices and this Policy. In the event of any amendment, a notice will be posted on www.dhontario.com. Policy changes will apply to the information collected from the date of posting to the DeMark Home Ontario’s web site as well as to existing information held by DeMark Home Ontario. You agree to review the Terms regularly and your continued access or use of the website will mean that you agree to any changes.

Resolving your Privacy Concerns

You can direct any questions or concerns about this Privacy Code to DeMark Home Ontario’s Privacy Officer. DeMark Home Ontario will maintain procedures to receive and investigate complaints and complainants will be advised of the results of any such investigation.
